These Terms of Use are an agreement between you and KIKA TECH (HK) HOLDINGS CO., LIMITED ("KIKA," "we," or "us") concerning your use of the Xboard host app, keyboard extension, and related services.
1. Eligibility
You must be legally capable of entering into this agreement under applicable law. If you are under 18, use Xboard only with the supervision, guidance, and consent of a parent or guardian.
2. License to Use Xboard
Subject to these Terms, KIKA grants you a limited, non-exclusive, non-transferable, revocable license to install and use Xboard on your devices for personal or internal business purposes. KIKA and its licensors reserve all rights not expressly granted in these Terms.
3. AI and Cloud Features
Xboard offers optional cloud features such as AI Write, voice input, and translation. When you actively use these features, text, audio, translation content, and required device or request information may be sent to cloud services provided by Kika, Agora, or Amphion.
See the User Privacy Policy and AI Data Privacy Agreement for the data types, recipients, and purposes. AI-generated or recognized results may be inaccurate. Review them before use or sharing.
4. User Content
You retain any rights you hold in content you enter, submit, or process. To provide a feature you actively request, you authorize KIKA to receive, transmit, and process that content only as necessary to provide the feature. You are responsible for ensuring that you have the right to submit the content and that it does not violate another person's privacy, intellectual property, or other legal rights.
5. Prohibited Conduct
When using Xboard, you must not:
violate applicable law or use the services to create or distribute unlawful or infringing content;
disrupt the services, bypass security measures, abuse an interface, or access a system without authorization;
rent, sell, sublicense, or otherwise transfer Xboard to a third party; or
reverse engineer, decompile, disassemble, or create derivative works from Xboard, except where applicable law expressly permits it.
6. Third-Party Services
Xboard may use system features, software, or cloud services provided by Apple, Agora, Amphion, and other third parties. Your use of those services may also be subject to their terms and privacy policies. KIKA does not control the continued availability of third-party services.
7. Intellectual Property
Xboard software, interfaces, trademarks, icons, documentation, and related content are protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any intellectual property rights to you beyond the limited license stated above.
8. Changes and Availability
We may update, change, suspend, or discontinue features to maintain security, comply with law, or improve the services. Cloud features may be temporarily unavailable because of network conditions, system permissions, third-party services, or maintenance.
9. Disclaimers
To the fullest extent permitted by applicable law, Xboard is provided "as is" and "as available." KIKA does not warrant that the services will always be uninterrupted, error-free, or suitable for every requirement. AI generation, speech recognition, translation, autocorrection, and candidate suggestions are assistive features and are not legal, medical, financial, or other professional advice.
10. Limitation of Liability
To the fullest extent permitted by applicable law, KIKA is not liable for indirect, incidental, special, punitive, or consequential losses arising from the use of, or inability to use, Xboard. These Terms do not exclude or limit liability that cannot be excluded or limited under applicable law.
11. Termination
You may stop using and delete Xboard at any time. If you materially breach these Terms, we may suspend or terminate your right to use related services. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, and dispute resolution, will remain effective.
12. Changes to These Terms
We may update these Terms. Material changes will be communicated through the website or an appropriate in-app notice and will apply from the stated effective date. Your continued use of Xboard after the changes take effect means that you accept the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People's Republic of China. Any dispute arising from or relating to these Terms shall be submitted to the China International Economic and Trade Arbitration Commission for arbitration under the rules in effect when arbitration is requested. The award will be final and binding on both parties.
